Onsite Filming & Photography Guidelines

Western Pennsylvania Conservancy (WPC) which owns and operates Fallingwater, extends every consideration to those wishing to film, tape, or photograph Fallingwater and its grounds.

WPC reserves the right to reject requests that, in WPC’s opinion, are not compatible with the mission, would interfere with the visitor’s experience, or put undue burden on WPC property or staff. Preference is given to documentary, news, and educational projects. To limit demands on the house and grounds, Fallingwater prefers to provide photography and footage whenever possible.

So that on-site filming and photography activities will neither interfere with normal operation nor compromise the safety of the building, the museum’s collections, and the grounds the following guidelines must be adhered to.

Advance Arrangements

Arrangements for filming, taping, recording, or photographing at Fallingwater must be approved in advance. WPC requires an official written request describing each proposed project prior to granting permission for use for filming, taping, recording or photographing WPC property. WPC must be fully informed of all production requirements in order to make arrangements. Specific rights needed for the proposed footage, audiotape, or photography must be included in this request. WPC reserves the right to require and review a script, where applicable or to refuse permission to use Conservancy property. Requests may be sent to:

Fees

WPC cannot underwrite the costs of a production by providing services without charge. WPC charges a location fee for one-time broadcast use of footage or audiotape, or one-time, one-edition use of still photography. In addition, WPC charges basic direct costs covering staff assistance during the shoot (Curator $40 per hour; Security $30 per hour; Maintenance $25 per hour). Any additional, subsequent, or different use of footage, audiotape, or photography (for example, redistribution in additional formats or media, such as CD-ROM, home videos or website postings) constitutes a reuse, must be applied for and approved in writing, and is subject to additional fees. All fees must be paid in advance of filming, taping, recording, or photographing by check or money order to WPC. Fees for reuse must be paid prior to the subsequent use.

Location Contract

WPC requires a completed, signed on-site Filming, Taping, and Photography Permission Request contract prior to the project’s start. The production company or photographer agrees to use the footage, audiotape, or images shot on Fallingwater property solely for the purpose listed on the agreement contract. A contract will be issued once approvals for the project have been granted.

Insurance

WPC requires a Certificate of Insurance for the amount of $1 million from those wishing to film, tape, or photograph Fallingwater and/or its property. The insurance certificate is evidence of proper insurance coverage and adequate limits of coverage for property damage and personal injury incurred on location. WPC must be named as an additional insured with respect to the work being done at Fallingwater. The producer or photographer must provide a waiver exempting WPC from damages or suit in case of property damage, personal injury, or other suit arising out of the production while at Fallingwater. Send the certificate and waiver at least one week prior to the start of on- site filming, taping, or photography to:

Restrictions

For film, video, or audio projects, one-time, non-transferable editorial rights for North America, English-language, broadcast distribution are authorized by the signed Agreement. For photography projects, one-time, non-transferable editorial rights for North American, English language, one-edition distributing are authorized by the Agreement. Any additional, subsequent, or different use (for example, CD-ROM, home videos, or website postings) constitutes a reuse and must be applied for and approved in writing.

WPC does not permit: its name, any images of Fallingwater, and the "FALLINGWATER" name to be used for non-WPC advertising. "FALLINGWATER" is a federally registered trademark and service mark owned by the WPC. In addition, it does not permit photography of Fallingwater, the museum’s collections or the WPC property for use in a stock collection.

Permissions to film, tape, record or photograph Fallingwater do not include or in any way grant any right or license to use “Fallingwater” or any image or rendition of Fallingwater as a trademark or service mark.

Please note that any commercial or third party use of the film footage/images/audio is not permitted without prior written approval from Western Pennsylvania Conservancy.  WPC is available to negotiate such terms prior or subsequent to the location visit but such an agreement must be in place prior to any third party use of the footage in any way.

Logistics

Fallingwater Staff Assistance: Photographers, videographers, producers, writers, and other technicians must be accompanied at all times by a Fallingwater staff member. Only the working film crew or photographer is permitted inside the Fallingwater house. No spectators, such as family members, are allowed. The crew is subject to approvals and conditions set forth by the WPC staff coordinator. No food, drinks, chewing gum, or tobacco products are permitted inside Fallingwater. No alcohol or drugs are permitted at any time. Smoking is not permitted on WPC property.

Interviews and Recorded Tours

Tours may not be recorded nor staff interviewed without prior written permission.

Exterior Photography

Approved exterior photography projects may be shot only during normal business hours, M-F (between 8:30 a.m. and 5 p.m., March through October, and between 9 a.m. and 4:30 p.m., November through February). Fallingwater is closed on Wednesdays.  WPC’s primary concern is for our visitors. Shoots may not interfere with normal visitor traffic. Special arrangements must be made at least 30 days in advance for shooting and taping before or after the normal hours of operation. Crews shooting exterior photography are prohibited from using special effects, dollies, and other equipment without the express advance consent of the film coordinator.

Aerial Photography

Aerial photography of Fallingwater is rarely permitted because of the risk to the house and grounds. Permission must be specially granted. Fallingwater’s Director must approve all requests in writing in advance.

Interior Photography

The museum’s collections and the house itself are precious. WPC requires that exceptional care be taken not to lean on walls or doors or to touch furnishings. Furnishings and other works of art have been arranged in historically accurate fashion and cannot be moved. Approved interior photography projects must be shot before or after normal business hours (noted above) or closed Wednesdays between 1–4 p.m. Advance explicit approval of the Director, and WPC support staff is required for all interior photography. Photographers, videographers, and technicians working inside the house must be accompanied at all times by a member of the WPC security or curatorial staff.

Interior Lighting

Electrical power is limited. The type and amount of electricity must be determined in advance with the consultation of the WPC Director of Maintenance. If the demand for electricity exceeds 60 amps, a licensed electrician, approved by WPC, must be present. WPC can, with advance notice, provide one at your expense. Either strobe or electronic flash lights should be used; flash bulbs or guns are not permitted. Rubber tips must be used on all tripods inside Fallingwater. Dollies are prohibited. Light-filtering window film covers many windows and cannot be removed for filming or photography.

Equipment

Photographers and technicians take full responsibility for all of their equipment. Damage and theft thereof are not the responsibility of WPC.

Vehicles

Vehicles have limited access on the Fallingwater grounds. Parking arrangements must be made in advance of shooting for all production vehicles.

Termination of the Project

WPC reserves the right to terminate production in the event that the photographer or production crew fails to abide by the conditions set forth. In such cases, all fees are forfeited.

Credit and Copies to Fallingwater

Fallingwater and Western Pennsylvania Conservancy must be credited. The form of credit must be approved in advance, in writing or if none is stated: “Courtesy of Western Pennsylvania Conservancy.” If space permits, we respectfully suggest inserting the following: “Fallingwater is located in Mill Run, Pennsylvania. WPC requires two complimentary copies of the completed work/project sent to the attention of:
